Is Delta-9 THC Legal in North Carolina, A 2026 Guide

With the current laws changing around hemp and THC, it’s natural to have some confusion about what is, and what isn’t legal currently in North Carolina.  With the hemp ban being signed into law last year, you may ask, can I still legally buy Delta 9 THC gummies here?

Well, yes you can!  As of now, and even though the laws will probably change before then, they are legal until November, 2026.  We do not sell or grow THCA flower, but that is also still legal, although some states and counties have begun preemptively cracking down on THCA flower.

As a Veteran Owned, Family Farm, we know the importance of sticking to the rules.  Here’s what you need to know about the current legal status of THC in NC.

When the 2018 Farm Bill was passed starting the federal legalization of hemp, the Golden .3% THC Hemp Rule was enacted.  This meant that any Cannabis plant or product that contained less than .3% DELTA 9 THC BY DRY WEIGHT was legally hemp.  Anything above .3% ∆9 THC was considered Cannabis, a Schedule 1 Controlled Substance and Federally Illegal.

Now, there’s a lot of confusion over what Delta 9 THC is as well, even among ‘experienced’ citizens.  Delta 9 THC, or ∆9 THC, is ‘THE THC’, the one in weed, marijuana, grass, cannabis, whatever you want to call it, what got you high, was Delta 9 THC.  ∆9 THC is a chemical, and while the number is used to sell cannabis across the country, the actual THC amount doesn’t determine the effect nearly as much as the terpene profile, the minor cannabinoids, but I digress.

Now with a product like gummies, which has weight, the THC can not be higher than .3% of that weight.  So for example, in our Ultra Chill gummies we added just enough hemp-derived ∆9 THC to our Full Spectrum CBD oil in the gummies to get it right to the .3% limit without going over, resulting in 16mg THC per gummy, while staying 100% Federally Legal.

So chemically speaking, THC derived from hemp, and THC derived from cannabis or marijuana are exactly the same.  The real difference in efficacy comes from the other cannabinoids such as CBD, and the terpene profile.  Terpenes mitigate the effects of cannabinoids such that the cannabinoids will not have the same effect without them.

Cannabis, outside of THCA flower, in North Carolina, is still illegal, although different areas view it differently.  We hope there will be a change in law soon that will open up NC to Medical and Adult Use Cannabis.  This is why our Hemp-Derived THC is the legal and safe way to get THC today in North Carolina.

So you’ve also probably seen THC and THCA products sold in gas stations.  What’s the difference between our gummies and that stuff?  When you buy our gummies, salves, seltzers or oils, you know who grew the hemp, that the product third party lab tested for potency and purity, and I guarantee those products are not made with the same ratios of CBD to THC as we offer, which are focused on wellness, and not getting super high from questionable gummies that make you feel weird.  We have Certificates of Analysis (COA) for all of our products, and you should look for these whenever you buy any hemp THC and CBD product to know what you are getting.

Gas station products may turn out to be illegal marijuna products with faked or forged COAs, so you have to know and trust who you are buying from.  All of our products are tested when created, and regularly to ensure our products’ consistency.
